“5 YEARS OF OWA”

 

These rules have been submitted to the Etude d’Huissiers de Justice (Bailiff’s Office), SCP Jorand Gobert Richard Van Gorkum, 10 bis rue Sarrazin 44000 Nantes, France.

 

The Organising Company: ARMOR SAS

Armor SAS, hereinafter the “Organiser”, a simplified joint-stock company with a sole shareholder (société par actions simplifiée à associé unique) having its head office at 20 rue Chevreul, 44100 Nantes, with a capital of 10,299,450 euros, registered with the Trade and Companies Register of Nantes under number 857 800 692, and represented by Alsens SAS, which in turn is represented by Mr Hubert de Boisredon in his capacity as President.

 

The Game: “5 YEARS OF OWA”

 

Article 1 - Context

Between 1 and 30 September, 2020, the Organiser will organise a game called "5 YEARS OF OWA" (hereinafter the "Game"), free with each purchase, which provides customers purchasing one or more OWA brand products having the characteristics set out in Article 2 with an opportunity to win one of the prizes described in Article 4.

 

Flyers bearing a scratch-card area and a brief description of the Game (see Annex 1) will be distributed to the said customers (i) by the Organiser in metropolitan France (including Corsica), and (ii) by each of the Organiser’s partner retailers in metropolitan France (including Corsica), Germany, the Netherlands and Belgium offering this Game (hereafter the "Partners") in order to create dynamics among our customers.

 

Article 2 - Participants

To take part in the Game, players must be of adult age at the date of the start of their participation in the Game, as mentioned in Article 3, and they must reside in one of the countries mentioned in Article 1 (hereafter the "Participants"). Participants may have purchased OWA brand products for themselves or for a third party.

 

The following may not play the Game and thus cannot be Participants: staff of the Organiser, their families, ascendants and descendants, and people directly or indirectly involved in creating the Game, their families, ascendants and descendants. Partners’ staff members may not take part.

 

The Organiser reserves the right to insist that any Participant prove that they meet the stipulated conditions.

Anyone who does not meet these conditions or refuses to provide proof that they do will be excluded from the Game, and, should they win, they will not be able to claim their prize.

 

Only one participation per household (same name, same address) is allowed for the entire duration of the Game. The Organiser reserves the right to carry out any checks needed to ensure compliance with this rule.

 

 

 

Article 3 – How to participate

The principle of the Game is as follows: between 1 and 30 September 2020, Participants wishing to take part in the Game must provide proof of purchase throughout this period of one or more products of the OWA brand. These products must have been purchased from a Partner offering this Game or from the Organiser in order to receive a scratch flyer, within the limits of available stocks. The Participant may then scratch the area of the flyer created for this purpose to find out whether s/he has won any of the prizes on offer.

 

If a Participant is a winner, s/he must send the following supporting information to the Organiser, in the format stated:

  • the Participant's first name, surname and contact information (phone number, email address and postal address) enabling the Organiser to contact her/him, and
  • a copy (scan or photograph) of proof of purchase (invoice or receipt only), with a circle drawn around the date of purchase, the name and quantity of the OWA brand products purchased, and
  • a recto-verso copy (scan or photograph) of the scratched area on the flyer showing the prize won.

 

This supporting information must be submitted electronically no later than on 30 September 2020 at 11:59 p.m., by filling out and validating the form available either by scanning the QR code printed on the flyer or via the website address given on the flyer, namely contact.armor-owa.com/5ans. The Game requires an Internet connection and a valid email address.

 

For a Participant's entry to be valid, the Participant must complete the supporting information form completely and accurately. Thus, the invoice or receipt must clearly indicate the purchase and date of purchase of one or more OWA brand products from a Partner offering this Game or the Organiser. In addition, the flyer must clearly indicate the prize actually won. The Organiser reserves the right to insist that any Participant justify any conditions in the claim form until handover of the prize, and in particular, that s/he provide the original proof of purchase and/or the flyer showing the prize won.

Any flyer, invoice or receipt that is torn, illegible or incomplete will be considered null and void and will not allow the Participant to take part in the Game. The same winning flyer cannot be used multiple times for different Participants.

 

All entries made in contravention of the provisions of these rules will be deemed void. Any participant suspected of fraud may be excluded from the Game by the Organiser without justification. Any identification, supporting information or entry that is incomplete, erroneous or illegible, whether deliberately or not, or submitted in any form other than that provided for in these rules will be considered null and void and will prevent the Participant from entering. The same sanction will apply in the event of multiple participations by a single Participant.

Description

Trip for two (2) people, the Participant and his/her companion, comprising two (2) nights in Copenhagen (Denmark), with accommodation in a three (3) star hotel or similar (one (1) standard room with a (1) double bed) in Copenhagen (breakfast included), and a return flight (in economy class) to and from the same capital of a country stipulated in Article 1 (Amsterdam / Copenhagen / Amsterdam; Berlin / Copenhagen / Berlin; Brussels / Copenhagen / Brussels; Paris / Copenhagen / Paris). Flights and hotel stays must be booked by the Winning Participant with the Organiser’s travel service provider within 12 months after 1 October 2020.

Reservations must be made in the Participant’s name.

The travel offer must be used by the Winning Participant within twelve (12) months from the booking date.

This does not include any expenses not explicitly described or provided for in these rules (e.g. travel or transfers to airports or connections between airports or to the hotel, any meals, drinks or personal expenses, any visits or excursions, any costs for changing the dates of the stay or flights booked, etc.).

The winner and his/her companion are liable to arrange all documents needed for their trip as well as for the flights and travel (e.g. ID). Estimated value: 480 euros per person.

The total number of prizes shall be determined by the Organiser at the launch of the Game and cannot be contested in any way.

 

Any costs incurred after the Game are entirely at the expense of the Winning Participant. The prize winner must respect the terms of use of the prize.

 

Article 5 – Selection of winners

Prize winners will be the Participants, i.e. persons as described in Article 2, meeting the stipulated conditions and for whom the Organiser has received a complete set of supporting information as described in Article 3.

Winners meeting all conditions will be contacted by the Organiser or its subsidiary in order to confirm their first name, surname and contact information (phone number, email address and postal address) to receive their prize, which will be sent out only in the country of purchase of the OWA brand product.

 

Article 6 – Prize handover

The prize will be sent to the winner by the Organiser or its relevant subsidiary by registered mail with proof of delivery to the postal address indicated on the supporting information by the winning Participant. Shipping costs will be covered by the Organiser or its relevant subsidiary.

 

If a prize cannot be delivered, it may be claimed by the winner for up to eight (8) days from the date of receipt by the Organiser of the returned prize. After this period, s/he may no longer claim it.

 

The winner agrees to accept the prize as is without any possibility of changes in size, quantity, destination, exchange, including for payment, for other goods or services of any kind, or transfer of the prize to a third party.

 

Subject to the provisions of the Article 8, the winner authorizes the Organiser or its relevant subsidiary to use his/her surname and first name on any medium for advertising or public relations, without remuneration, rights or benefits other than the actual award of the prize.

 

The Organiser reserves the right, in the event of an event beyond its control, in particular relating to its suppliers or to unforeseen circumstances, or in the case of depletion of available stocks or unavailability of prizes, to replace the advertised prize with another prize of equivalent type and/or value. The winner will be kept informed of any changes but may not contest such changes.

 

Article 7 – Game Rules

Participation in this Game implies full acceptance of these rules in their entirety.

Failure to comply with these rules will result in automatic cancellation of participation and award of the prize.

 

These rules have been filed in French, along with their German and Dutch versions, with the Etude d’Huissiers de Justice, SCP Jorand Gobert Richard Van Gorkum, 10 bis rue Sarrazin 44000 Nantes. In the event of any conflict between the French version of these rules and any of its translations, the French version shall prevail.

 

The full rules are available, free of charge, to anyone requesting them by going to the bailiffs' office, by visiting the electronic form page mentioned in Article 3 above, or by sending an email to the Internet address armor.op@armor-group.com and stating the following subject line: "5 YEARS OF OWA - Request for Game rules". The rules can also be sent to anyone requesting them by standard mail to the following address: ARMOR SAS - AOP Marketing Service - Game 5 YEARS OF OWA - 20 Rue Chevreul, CS 90508, 44105 Nantes Cedex 4. The postage costs of sending this application can be refunded in euros on a simple request up to the price of a second-class stamp.

 

 

 

Article 8 – Protection of Participants’ personal data

Participants’ personal data (surname, first name, telephone number, home address and e-mail) will be processed by the Organiser for the purposes of participation in the Game and award of prizes.

 

This data will be collected by the Organiser in its capacity as the data controller, under the applicable conditions for lawful processing (Participant’s consent), and will be sent, where necessary, to those who require this information in the marketing and commercial departments, as well as the administrative, logistical and IT departments of the Organiser. In order to make the prizes available, the Organiser may be required to pass on the information collected to its subsidiaries located in partner countries or to its suppliers. The data will be retained for the maximum period provided for by the applicable regulations.

 

In accordance with the French Data Protection Act (Loi Informatique et Libertés), as amended, and the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, the Participant may exercise his/her right to access, to rectification and to erasure of his/her personal data, to restriction of processing thereof, to data portability and to object or to withdraw consent, by contacting the Organiser at the following address: Armor SAS, for the attention of the DPO, 20 rue de Chevreul, CS 90508, 44105 Nantes Cedex 4, France. Following such a request, the Organiser will inform the Participant of the actions taken as soon as possible within one (1) month of receipt. In case of a complex case, the Organiser will inform the Participant that this period may be extended by two (2) months. In the absence of a satisfactory response from the Organiser, the Participant has also the right to lodge a complaint with a supervisory authority.

 

Article 9 - Liability

All trademarks, labels, photographs, domain names and product names referred to in this Game remain the property of their owners or copyright owners. The photographs and illustrations used on the flyer have no contractual character. Please dispose of the flyer properly, do not litter.

 

The Organiser shall not be liable for any delays, losses, theft, damage or non-receipt of mail, emails and/or prizes, illegibility of stamps arising from the postal services or delivery of prizes. Nor can it be held liable and no appeal can be made against it in case of events beyond its control, such as the interruption of postal services, or instances of force majeure (strikes, bad weather, etc.) that either partially or totally deprive the Participants of the opportunity to play the Game and/or deprive any prize-winner of enjoying their prize.

 

The Organiser shall not be liable for any difficulties related to the use of a prize and recommends that the winner contact the competent department of the relevant service provider.

 

The Organiser shall not incur any liability as a result of the organisation of this Game, in particular, if in the event of force majeure or other circumstances, it is forced to cancel, shorten, modify, extend or postpone the Game.

 

The Organiser and its relevant subsidiaries, service providers and Partners shall not be liable for any incidents occurring through use of the prize once the winner has taken possession of his/her prize.

 

Similarly, the Organiser, as well as its relevant subsidiaries, providers and Partners, shall not be liable for loss, damage or theft of the prize once the prize has been sent by the Organiser to the winner and/or as soon as the winner has taken possession thereof. Any additional costs necessary to take possession of the prize are entirely at the expense of the winner without the winner being entitled to claim any compensation from the Organiser, or its relevant subsidiary, or from its service providers or Partners.

 

Article 10 - Dispute & Claims

These rules are governed by the French law.

In order to be taken into consideration, all claims relating to the Game must be submitted in writing, no later than thirty (30) days after the deadline for participation in the Game as indicated herein, i.e. no later than on 30 October 2020 at 11:59 p.m., to the following address:

If no agreement can be reached regarding the performance or construction of these rules, and in the absence of an amicable agreement, all disputes will be submitted to the competent court of Nantes, which shall have sole jurisdiction.

 

 

Annex 1 – Flyer

1. Scan the QR CODE below or visit the site https://contact.armor-owa.com/5ans to complete the form provided with your supporting information as indicated below, no later than 11:59 p.m. on 30 September 2020:

‐      first name, surname and contact details (telephone, email and postal address) to enable the Organiser to contact you, and

‐      a readable copy (scan or photograph) of proof of purchase (invoice or receipt only) with a circle drawn around the date of purchase, the amount and the name of the OWA brand products purchased,

‐      a recto-verso copy (scan or photograph) of the scratched area on the flyer showing the prize won.

2. Each winning participant meeting the conditions will be contacted in order to arrange delivery of the prize to the postal address indicated in one of the 4 countries in which the Game is held.

Prizes

3 trips to Copenhagen (Denmark) and 250 custom reusable bottles bearing the OWA® brand ("prizes"). Trip for 2 people (the Participant and his/her companion) comprising 2 nights in Copenhagen (Denmark), with accommodation in a 3-star hotel or similar (1 standard room with 1 double bed, including breakfast), and including a return flight (economy class) to and from the same capital of one of the 4 countries in which the Game takes place. Flights and hotel stays must be booked by the winning participant, in his/her name, with the Organiser’s travel service provider within 12 months of 1 October 2020, and they must be used within 12 months from the time of booking. This does not include any expenses not explicitly described or provided for (e.g., travel or transfers to airports or connecting between airports or to the hotel, any meals, drinks or personal expenses, any visits or excursions, any costs for changing the dates of the stay or flights booked, etc.).

Terms of participation

1. Buy at least one OWA brand product from Armor SAS (the "Organiser") or from a partner retailer in metropolitan France (including Corsica), Germany, the Netherlands or Belgium from among those offering this Game (“Partners”) between 1 and 30 September 2020 in order to receive this flyer and scratch the relevant area to find out whether you have won a prize. The Game is restricted to adult individuals residing in one of these 4 countries, and is limited to one participation per person and per household (same name, same address).

2. Any participation that does not comply with the terms of the Rules of the Game will not be considered. The Organiser reserves the right to request justification of compliance with these conditions at any time. The prize is non-refundable and cannot be exchanged for another prize of a similar value or type.

3. The Organiser shall not incur any liability due to the organization of the Game or the availability of a prize, and reserves the right, at any time, in the case of an event beyond its control, to cancel the Game, shorten it, modify it, extend it or postpone it, or to replace the prize with a prize of an equivalent type and/or value. In particular, the Organiser shall not be held responsible for the non-receipt of applications for participation and/or prizes due to problems beyond its control.

4. Non-contractual photographs and illustrations. All trademarks, labels, photographs, domain names and product names cited remain the property of their owners or copyright holders.

5. In accordance with the Personal Data Protection Policy available on www.armor-owa.com and upon simple request, any concerned natural person may contact the Organiser to exercise his/her right to access, to rectification and to erasure of his/her personal data, to restriction of processing thereof, to data portability, to object and to withdraw consent given in connection with his/her participation in the Game.

6. The Game is subject to the conditions set out in the rules of the Game filed with the Etude d’Huissiers SCP Jorand Gobert Richard Van Gorkum, 10 bis rue Sarrazin 44000 Nantes, available free of charge on the electronic form page or upon a request submitted to the Organiser.
